Assault and Battery

It’s essential to know that assault and battery laws vary by state. In Utah, sexual battery is considered a crime, but other than that, the state doesn’t recognize a distinct battery crime. Instead, the term “battery” is usually used as an umbrella term for assault, including crimes. Assault charges can range from a Misdemeanor B to a second-degree felony. They can also result in consequences like jail time and a criminal record.

Child Abuse and Neglect

Being charged with child abuse and neglect is a grave matter, especially if you are sharing custody with your ex-spouse. Your custodial rights will be challenged in court, so it’s important to have a lawyer representing your side. Schmidt Law Firm will work tirelessly to give you and your children the best potential results.

Domestic Violence

Domestic violence is an either attempted or accomplished act of violence towards a cohabitant, which is usually a current or ex-spouse or any other blood-related relative. Examples of domestic violence include:

  • Harassment
  • Stalking
  • Assault
  • Violation of protective order

If you have been charged with domestic assault or violence, contact Schmidt Law Firm immediately. Our team will evaluate your case and begin working on the best route for your situation.

If you are a victim of domestic violence, then take a look at how to protect yourself from domestic violence and call Schmidt Law so that our team can help guide you through this process.

DUI

A driving under the influence (DUI) charge is given when you operate a motor vehicle with a blood alcohol content (BAC) of .05% or more. This is a severe charge since it is considered public endangerment, where you may face criminal allegations or be indicted.

After your arrest, the first thing the police will do is detain you and take your license away. You can then expect a court date within 30 days, so be sure to have an experienced lawyer who is prepared to help you.

The good news is that DUI charges are not always a sure thing, and Schmidt Law can help protect your rights and work to get the lowest possible punishment.

Drug Possession

Drug possession is when you have been charged with possession of a controlled substance. This is different from possession with intent to distribute, which has different consequences.

Utah divides controlled substances into five categories, which are called schedules:

  • Schedule I: Heroin, LSD, cocaine, and marijuana
  • Schedule II: Hydrocodone and methylphenidate
  • Schedule III: Anabolic steroids and medications with codeine
  • Schedule IV: Valium and Ambien
  • Schedule V: Low-dose narcotics that are commonly prescribed for medical use

Depending on your case, you may be charged with a misdemeanor or felony. No matter the category or charge, Schmidt Law can help guide you through the conviction and aim to get you the smallest possible sentence.

Sex Crimes

Sex crimes are any type of sexual activity that is suspected of having deviant intent. These charges can result in a hefty fine, a criminal record, and jail time. They are also harmful to you, your family, and your community. In some cases, you may have to register on the Sex Offender Registry.

Each type of sex crime is punishable. Depending on the individual charges, you may be charged with a Class A Misdemeanor or a felony, which range from life in prison without parole to less than five years. Some common sex crimes include:

  • Aggravated sexual assault
  • Rape
  • Forcible sexual abuse
  • Sexual abuse of a minor

If you have been charged with a sex crime or are the victim of one, the absolute best way to protect yourself in cases like this is to seek legal counsel. Schmidt Law Firm is experienced and compassionate in sensitive situations like this.

Expungement

Record expungements are an excellent opportunity for those with criminal records. Expungements completely erase past arrests and convictions, but to qualify you have to fill out an application through the Department of Public Safety. They will have reevaluated your case and made a decision within ten to twelve weeks.

If you were convicted of a crime and want to appeal your criminal record, one of the attorneys at Schmidt Law could help you through the record expungement process.
